THE MAN gardai suspect shot dead Veronica Guerin had electronic devices hidden in his shoes after he was arrested, the Special Criminal Court was told yesterday.
Gardai found a listening and receiver device in Patrick Holland's shoes when he was taken to Lucan garda station the headquarters of the Guerin murder investigation last April.
Other electronic equipment capable of monitoring faxes and mobile phones was found at a hotel room opposite Tallaght garda station,[link widoczny dla zalogowanych], and packaging from that equipment was found in a bed and breakfast near the garda station, the court was told.
The court also heard that Holland's solicitor, James Orange, was arrested by officers from the Criminal Assets Bureau who were investigating money laundering offences connected with the sale of Holland's house at Brittas Bay in Co Wicklow.
Mr Orange was arrested shortly after Holland on April 9 this year. But gardai denied that the arrest of both men at the same time was a ploy to deny Holland access to his choice of solicitor.
The court heard Garda evidence yesterday on the issue of the legality of Holland's detention at Lucan garda station after his arrest at Dun Laoghaire on April 9.
Garda Marion Cusack, who arrested Holland, said she believed he was the man who shot dead Ms Guerin on the Naas Road on June 26,[link widoczny dla zalogowanych], 1996.
Patrick Eugene Holland (5Cool, a native of Dublin, with an address at Brittas Bay, Co Wicklow,[link widoczny dla zalogowanych], denies possession of cannabis for the purposes of sale or supply within the State on a date unknown between October 1, 1995,[link widoczny dla zalogowanych], and October 6,[link widoczny dla zalogowanych], 1996.
Detective Inspector Thomas O'Loughlin, Lucan, said he joined the team investigating the Guerin murder on July 1, 1996. He received a phone call from solicitor Mr Orange on April 4 last stating he was acting for Patrick Holland and that Holland would not be keeping an appointment to attend at Lucan garda station that day.
Mr Orange said Holland would attend on April 7 but he did not nor did he attend on a previous occasion,[link widoczny dla zalogowanych].
On April 8,[link widoczny dla zalogowanych], he received confidential information that Holland was at Holyhead and that indicated he would be travelling to Ireland and he instructed other gardai to monitor ports and airports.
The following morning he was told that Holland had been arrested and was being detained at Lucan garda station.
Det Insp O'Loughlin said the decision to take him to Lucan was made because Lucan was the headquarters of the investigation into the murder of Veronica Guerin and all the evidence relating to the murder and ``surrounding criminality'' was kept there in several thousand statements kept in several fireproof safes,[link widoczny dla zalogowanych].
He said all the exhibits, the computer and the clerical back-up were also in Lucan and special security arrangements had been made there.
At 11am on April 9, he was contacted by a detective inspector from the Criminal Assets Bureau about an investigation he was carrying out into alleged money laundering offences relating to the sale of Holland's house at Brittas Bay.
He also became aware that Mr Orange had been arrested in connection with that investigation. Det Insp O'Loughlin said he was told that Holland had requested through his solicitor Elizabeth Ferris, Mr Orange's wife,[link widoczny dla zalogowanych], that any interviews should be recorded on video but there were no facilities for such recording at Lucan.
He said the inspector from the Criminal Assets Bureau also informed him that Ms Ferris was involved in the investigation into the alleged money laundering and on that basis he informed Holland that he could not be seen by Ms Ferris as this could hinder both investigations,[link widoczny dla zalogowanych].
Cross-examined by Brendan Grogan SC, for Holland, Det Insp O'Loughlin said he had no objection to the recording of the interviewing of suspects by the gardai and said he was aware of a pilot scheme to video interviews at Tallaght and the Bridewell garda stations.
He said special arrangements were in place at Lucan to check the integrity of phones and faxes and these were checked on a regular basis,[link widoczny dla zalogowanych].
``I was extremely worried as a result of items which had been found during a search of Holland's clothing which indicated that attempts were being made to monitor the progress of the investigation,'' he said.
He said he also suspected that moving Holland to another station could jeopardise the investigation,[link widoczny dla zalogowanych].
Det Insp O'Loughlin said a listening device and receiver were found in Holland's shoes and they ended up in one of the incident rooms before they were detected by gardai.
He said he decided to keep Holland at Lucan station for interview for ``operational and security reasons.''
Re-examined by prosecuting counsel Peter Charleton,[link widoczny dla zalogowanych], Det Insp O'Loughlin said a hotel room was located across from Tallaght garda station which had been retained by an associate of Holland who was later taken into custody.
